As holder of AFSL 258057, Proprietary & Fiduciary Services maintains the licence-level governance framework required under the Corporations Act 2001. Network members operate within that framework — and are individually responsible for ensuring their conduct, activities, and obligations meet the standards the licence demands.

If you held your own AFSL, you would be responsible for maintaining all of the governance arrangements required by ASIC: organisational competence, supervisory frameworks, conflicts management, recordkeeping, incident escalation, and more.

As a network member under AFSL 258057, the licence-level obligations sit with us. We have maintained them continuously since 2001. You operate within that framework from day one — bringing your own governance capability and accepting individual responsibility for your conduct and authorised activities.

Governance framework

Six areas of the licence framework
we maintain for the network.

I

Organisational Competence

We maintain documented arrangements ensuring the licence holder and each CAR possess the competence required to deliver their authorised services effectively.

Supervision of Representatives

Each CAR is subject to a monitoring regime calibrated to the nature and scale of their authorised activities. Proportionate, not burdensome.

Conflicts Management

Documented procedures govern the identification, disclosure, and management of conflicts of interest across the licence. Network members benefit from a framework already in place.

IV

Recordkeeping

Comprehensive records are maintained in accordance with Corporations Act 2001 requirements, covering financial services activities and compliance outcomes.

Incident & Breach Escalation

A formal escalation framework governs incident response. CARs notify us; we manage the response and regulatory liaison where required.

Training & Competence

Representatives maintain competence to perform authorised activities and comply with applicable training obligations under the licence conditions.

Network membership carries real obligations. Each partner accepts individual responsibility for operating within their authorised scope, maintaining standards consistent with the trust on which the network is built.

Pre-appointment

  • Provide accurate information about your business
  • Demonstrate governance and compliance capability
  • Enter a written appointment agreement
  • Agree to the authorised scope of activities

Ongoing

  • Operate within your authorised scope
  • Maintain applicable training and competence
  • Notify us promptly of material changes
  • Comply with supervisory and reporting requirements

If issues arise

  • Notify us as soon as practicable
  • Co-operate with any investigation or review
  • Maintain accurate records of the incident
  • Follow the agreed escalation framework
